Trump Document Case Tossed Out

Nearly two years after the Biden Administration authorized the use of force during the FBI’s raid on President Trump’s home in Mar-a-Lago, U.S. District Judge Aileen Cannon dismissed the case against the former president. The August 8, 2022 raid has been a point of contention, with critics arguing it demonstrated excessive measures by federal authorities.

Judge Cannon ruled that the appointment of a special counsel by Attorney General Merrick Garland was unconstitutional. Justice Clarence Thomas had previously noted that without a law establishing the office of Special Counsel, such prosecutions cannot proceed. He further stated that "a private citizen cannot criminally prosecute anyone, let alone a former President." This perspective was echoed by Judge Cannon in her decision to dismiss the case.
