Congressman Gosar Applauds Supreme Court Decision Halting Biden’s Student Loan Forgiveness Scam

Phoenix, AZ - Congressman Paul A. Gosar, D.D.S. (AZ-09) issued the following statement in response to the United States Supreme Court’s decision striking down Biden’s misuse of executive privilege to forgive student loans:

“The Supreme Court’s 6-3 ruling that Biden cannot go forward with his student loan forgiveness scam is something even liberal Nancy Pelosi agrees with.  In striking down Biden’s stunt, the High Court cited Pelosi’s previous comments that Biden does not have the power to forgive debt noting it “has to be an act of Congress.”

Seldom do I agree with Nancy Pelosi but in this instance she and the High Court are both correct.  There is no federal law that allows Biden the power to cancel billions of dollars in student loan debt.   Let’s be perfectly clear, debt cannot simply be forgiven.  Instead, the debt is merely transferred to taxpayers, many of whom paid for their college education out of their pockets or responsibly paid off their student loans.

In striking down Biden’s unconstitutional loan forgiveness stunt, the Supreme Court’s decision reaffirms that there are three separate and equal branches of government,” said Congressman Gosar.  

Background:

In its 6-3 decision, the Supreme Court held that the federal law does not allow the Secretary of Education to cancel more than $430 billion in student loan debt.  Previously, by executive order, Mr. Biden claimed that the COVID-19 national emergency declaration provided the federal government justification for student loan forgiveness.  Mr. Biden signed into law H.J. Res 7, legislation introduced by Congressman Gosar, terminating the COVID-19 national emergency declaration on April, 10, 2023.
